Justice Nagaprasanna defers order on Mantri Mall’s property tax plea to Jan 12

On Dec 10, Mantri Mall was unsealed by BBMP on order of HC

BENGALURU:

The Karnataka High Court has ordered the Mantri Mall management to deposit another Rs 2 crore to the BBMP.

Justice M Nagaprasanna, who was scheduled to dictate orders in a petition filed by M/s Abhishek Propbuild Private Ltd in appeal against BBMP’s move to lock Mantri Mall in Malleswaram, has directed the petitioners to deposit another Rs 2 crore before January 10, 2022.

Earlier Rs 2 crore

Earlier, the HC had directed the mall management to deposit a DD for Rs 2 crore with BBMP.

Justice Nagaprasanna, who heard the petition on December 23, said: “Though the matter was heard and listed for dictating orders, both learned counsel appearing for the petitioner and the respondents submit that there are other submissions also to be made with regard to the claim of the respondents — BBMP — on payment of property tax. Learned counsel appearing for the petitioner is directed to deposit Rs 2 crore on or before 10.01.2022, and the remainder would depend upon the directions to be issued by this court. Release the matter from the status of part-heard. List the matter on 12.01.2022. Interim order granted earlier is extended till the next date of hearing.”

Earlier, on December 13, the court had decided to announce the order, but Justice Nagaprasanna was on leave.

Mantri Mall was unlocked on December 10 at 10 pm after the High Court intervened. BBMP had sealed the mall, demanding Rs 27 crore in property tax arrears, including the interest amount.
