Terms of Service

These Terms of Service (“Terms”) govern your use of https://thebengalurulive.com/ and https://kannada.thebengalurulive.com/ (together, the “Websites”). The Websites are operated as The Bengaluru Live (“TBL”, “we”, “us” or “our”) by an individual/sole proprietorship in Bengaluru, Karnataka, India.

1. Acceptance of these Terms

By accessing or using the Websites, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Websites.

2. News and editorial information

The Websites publish news, information, opinion, analysis and other editorial material for general informational purposes. We aim for accuracy and may correct, update, remove or revise material when appropriate. News develops quickly; content may not always be complete, current or free from error. You should independently assess information before relying on it for personal, legal, financial, medical, business or other consequential decisions.

3. Availability and changes

We may modify, suspend, restrict or discontinue any part of the Websites, content or features at any time, including for maintenance, security, legal or editorial reasons. We do not guarantee uninterrupted, error-free or secure availability.

4. Intellectual property and permitted use

Unless otherwise stated, the Websites and their content, including text, photographs, graphics, videos, branding and layout, are protected by applicable intellectual-property laws and belong to TBL or the relevant rights holder.

You may access and use the Websites for lawful personal and non-commercial purposes. You may share links and make limited fair dealing/fair-use references with clear attribution where permitted by law. You must not reproduce, republish, distribute, sell, license, systematically archive or create a substitute service from substantial portions of the Websites without prior written permission, except where applicable law permits.

5. Prohibited use

You must not misuse the Websites. This includes scraping or harvesting content or data at scale; using bots, crawlers or automated systems except as permitted by applicable law and our robots instructions; interfering with security, servers or website operation; bypassing access controls; introducing malware; impersonating another person; infringing rights; or using the Websites for unlawful, harmful or misleading purposes. This clause is not intended to prohibit good-faith indexing by search engines or other automated access expressly permitted by our robots instructions.

6. Third-party services, links, advertising and sponsored content

The Websites may contain third-party links, embedded services, advertisements and sponsored or partner content. Third parties are responsible for their own services, content, offers, terms and privacy practices. A link, advertisement or mention does not by itself constitute TBL’s endorsement. Sponsored or partner content will be identified where appropriate.

7. Voluntary reader contributions

TBL may invite readers to voluntarily support its journalism through Google Reader Revenue Manager (“RRM”). Under TBL’s current Contribution Request model, normal news content remains freely accessible. A contribution does not buy editorial influence, ownership, exclusive access or any benefit unless TBL expressly states otherwise at the relevant time.

Readers may be offered one-time contributions and/or recurring monthly contributions. The available amounts are displayed through the applicable RRM payment flow and may change from time to time without requiring amendment of these Terms.

Recurring support continues according to the applicable payment arrangement until cancelled. Cancellation is intended to prevent future recurring charges, subject to the applicable billing and payment process; it does not necessarily reverse a charge already processed or change rights for a current billing period.

Payments are processed using Google Reader Revenue Manager, Google Payments and/or the relevant third-party payment provider, as applicable. You are responsible for providing accurate payment information to the payment provider and for complying with its terms. TBL does not represent that it receives or stores your complete card or bank-account credentials.

8. Refunds, cancellation and taxes

Requests concerning a contribution, cancellation or refund are subject to the applicable Google Reader Revenue Manager/payment process and applicable law. TBL does not promise automatic refunds or a fixed refund period in these Terms. Where appropriate, you may contact atulchaturvedi@thebengalurulive.com for support.

Applicable taxes, if any, will be accounted for in accordance with applicable law and the payment arrangement. A reader contribution is not a charitable donation, and TBL does not represent that a contribution is tax-deductible. We do not make any representation about a reader’s tax treatment.

9. Disclaimer

The Websites and their content are provided on an “as available” basis. To the maximum extent permitted by law, TBL disclaims warranties that are not expressly stated in these Terms, including implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, TBL will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, data, goodwill or opportunity, arising from your use of or inability to use the Websites, reliance on content, third-party services or reader-contribution processes. Nothing in these Terms limits liability where such limitation is prohibited by law.

11. Restriction or termination

We may restrict or end access to the Websites or features where we reasonably believe there has been misuse, a security risk, infringement, unlawful conduct or a breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The effective date above will indicate the latest revision. Continued use of the Websites after updated Terms take effect means that you accept them, to the extent permitted by law.

13. Governing law, jurisdiction and contact

These Terms are governed by the laws of India. Subject to applicable law, courts in Bengaluru, Karnataka will have jurisdiction over disputes arising from or relating to these Terms.
