Congress heavyweight DK Shivakumar seems to have attracted the attention of the country’s investigative agencies for all the wrong reasons. First, it was the Income-Tax department, then the Enforcement Directorate, and now the CBI which raided the Karnataka Congress chief’s homes/offices on Monday. As per the the CBI’s FIR,  DK Shivakumar allegedly accumulated disproportionate assets in 5 years from April 1, 2013 to April 30, 2018. 

The 6-page FIR filed by the CBI’s Bengaluru anti-corruption branch headed by Superintendent of Police Thomson Jose, a copy of which is exclusively available with TheBengaluruLive, alleges that Shivakumar, who was a public servant during the period under scrutiny, committed criminal misconduct by amassing assets disproportionate to his known sources of income.

As per the FIR, a preliminary enquiry was initiated on March 12, 2020 by the CBI’s ACB against DK Shivakumar, Anjaneya Hanumanthaiah and Shashi Kumar S. The enquiry was conducted to ascertain whether the said facts prima facie revealed that DK Shivakumar and his family members were in possession of assets disproportionate to their known sources of income during the said period, and whether Anjaneya Hanumanthaiah and Shashi Kumar aided him in this regard.  

The enquiry officer submitted a report which prima facie stated that DK Shivakumar and his dependent family members amassed assets disproportionate to their known sources of income during the period from April 1, 2013 to April 30, 2018. During this period, Shivakumar was functioning as a public servant in the capacity of cabinet minister in the Karnataka government, the report maintained. 

The facts disclosed in the preliminary enquiry are: 

DK Shivakumar and his family members were found to be in possession of  moveable and immoveable assets to the tune of Rs 33,92,63,793 at the beginning of the check period; that is, as on April 1, 2013, and these details are also available in the election affidavit dated April 13, 2013 of DK Shivakumar. During the check period from April 1, 2013 to April 30, 2018, DK Shivakumar and his family members acquired assets, moveable and immoveable, to the tune of Rs 128,60,81,700 and the total value of all assets held by them at the end of the check period, that is, as on April 30, 2018, is to the tune of Rs 162,53,44,494. It is further disclosed that their total income and receipts during the check period was to the tune of Rs 166,79,58,216 and their total expenditure was to the tune of Rs 113,12,16,585. Therefore, they are found to be in possession of assets disproportionate to the tune of Rs 74,93,40,069, which is 44.93% of their total income during the check period, and which cannot be satisfactorily explained by the accused. 

The FIR has further said that the above facts prima facie disclose commission of offences punishable u/s 13(2) r/w 13 (1)(e) of PC Act 1988 by DK Shivakumar, and hence the FIR.
