NCDRC comes to the rescue of Dreamz Infra home buyers

The National Consumer Disputes Redressal Commission (NCDRC) has allowed a class-action consumer complaint by 18 homebuyers against Bengaluru-based builder Dreamz Infra India Ltd.
Justice RK Agrawal, President and Dr.SM Kantikar, Member ordered the builder to either deliver possession of flats within one year with interest or return of the entire amount with interest within six weeks.
The company, whose Managing Director is actress Disha Choudhary, advertised the project Dreamz Sneh in March 2012. The home buyers who entered the agreement were promised delivery of the flats within 18 months extendable by six more months.
Even though the buyers has paid 80-95 per cent of the cost, the project was not completed even in 2017. Basanta Kumar Nandy, Manoranjan Dash, Anand Gupta and 15 other home buyers approached the NCDRC in 2017.
In its order on June 27, the Commission directed the builder to complete the project, obtain occupancy certificate and deliver possession to the 18 home buyers within one year. For the delay caused, the builder will pay a delay compensation of nine per cent interest per annum. Apart from that the builder will also pay Rs.50,000 each to the 18 home buyers as cost.
As an alternative, the Commission also ordered that if any of the home buyers don’t want to wait for one year or if the builder is not able to give possession within one year, the entire amount paid by them would be returned with nine per cent interest within six weeks. Again, the cost at Rs.50,000 each will have to be paid by the builder.
For the home buyers advocate Chandrachur Bhattacharyya argued the case before the Commission.
It was alleged that the Developer regularly raised demands on the home buyers for payment of installments but the same was diverted elsewhere.
