Karnataka Government Withdraws Hijab Restriction Order in Educational Institutions

Bengaluru: The Karnataka Government has officially withdrawn the controversial February 5, 2022 order relating to dress code restrictions and hijab in educational institutions across the state. The decision was announced following a Cabinet meeting chaired by Chief Minister Siddaramaiah.

The withdrawn order, issued on February 5, 2022, had directed educational institutions to follow prescribed uniform rules and had effectively led to restrictions on wearing hijab inside classrooms in several government educational institutions across Karnataka.

Government Cites Constitutional and Educational Concerns

According to the government note released after the Cabinet decision, the earlier order had created confusion and unrest among students and sections of society, affecting harmony within educational institutions.

The government stated that education must remain accessible, inclusive and free from unnecessary discrimination or social division. Officials noted that several representations were received from students, parents, organisations and members of the public seeking withdrawal of the order.

Earlier Order Withdrawn

The Cabinet resolved to withdraw the Government Order No. EP 14 SHS 2022 dated February 5, 2022, issued by the Department of Primary and Secondary Education.

The government clarified that:

  • Educational institutions will continue to maintain discipline and uniform systems as per existing rules.
  • Students’ constitutional rights and educational opportunities must be protected.
  • School development committees and institutional authorities should ensure harmony, peace and equality among students.

Focus on Social Harmony

The Cabinet note emphasised that Karnataka is a diverse state with multiple religions, languages and cultural traditions, and educational institutions should function in a spirit of mutual respect and inclusiveness.

The government also stated that education should not become a platform for social conflict or discrimination and that students must not be deprived of learning opportunities because of dress-related disputes.

Background of the Hijab Row

The hijab controversy had first erupted in Karnataka in early 2022 after students in some colleges sought permission to wear hijab inside classrooms. The issue later escalated into a major political and legal debate across the country.

Following the state government’s February 2022 order, the Karnataka High Court had upheld restrictions linked to prescribed uniforms in educational institutions. The matter later reached the Supreme Court, where differing opinions were delivered by a division bench, and the issue remained under further consideration.

The latest Cabinet decision effectively revokes the 2022 government order and marks a significant policy shift by the Karnataka Government regarding dress code regulations in educational institutions.
