BENGALURU:
The High Court has issued a notice to the Chief Commissioner of BBMP, Tushar Giri Nath, regarding the illegal shops in the basement of Jayanagar Shopping Complex, which were supposed to be demolished within three years, as per the 2020 order.
The notice was issued in the background of the unsuccessful implementation of the High Court’s order by the Chief Commissioner of Bruhat Bengaluru Mahanagara Palike (BBMP).
The division bench, headed by Chief Justice Prasanna B. Varale and Justice N. Krishna S. Dixit, conducted the hearing.
During the hearing, it was revealed that the basement of Jayanagar Shopping Complex is temporarily being used to provide space for the old permit holders, and after the construction of Blocks 2, 3, and 4 within three years, it will be used as a parking area, as informed to the High Court by BBMP.
However, the petitioner, R.R. Hiremath, a lawyer, along with G.R. Mohan, alleged that BBMP has failed to construct the other blocks and remove the illegal shops from the upper basement parking floor. Therefore, they requested the High Court to take action against BBMP for non-compliance with the court order.
Chief Justice Prasanna B. Varale and Justice N. Krishna S. Dixit, after analyzing the case, issued a notice to Tushar Giri Nath, the Chief Commissioner of BBMP, and directed him to present his arguments in the next hearing.
