BENGALURU:
In a significant ruling, the Karnataka High Court has imposed a ban on all mining activities within a 20-kilometer radius of the Krishnarajasagar (KRS) Dam. The order, issued by Chief Justice P.B. Varale and Justice Krishna S., comes in response to a petition filed by CG Kumar of Chinakurali village in Mandya district, which has been converted into a public interest petition.
The KRS Dam, a vital water source for the Mysore and Mandya districts, is already facing distress, with reports of loud noises near its vicinity. Recognizing the potential risks associated with mining in the area, the High Court has taken a proactive step to protect the dam.
Furthermore, the Indian Institute of Mines and Energy Research at Dhanbad has been directed to conduct a scientific survey of the KRS Dam. Until the survey is completed and the report is submitted, the High Court has prohibited any mining activities in the surrounding area.
The construction of the KRS Dam in 1924 marked a significant milestone in harnessing the Cauvery River’s resources for irrigation purposes in the fertile Mysore and Mandya regions. Preserving the integrity of the dam is of utmost importance, as emphasized by a division bench of the High Court. The government’s directive for a scientific survey further underscores the commitment to safeguarding the KRS Dam.
The ban extends to existing mining licenses and operations that were previously granted permission by the High Court. Any activity that poses a threat to the KRS Dam and its functioning will not be tolerated.
The construction of the KRS Dam stands as a testament to the dedication and hard work of countless individuals. It is a symbol of progress and prosperity for the region. Disregarding the potential consequences of damaging the dam would be a grave mistake.
Three states are currently engaged in a heated battle over the precious resource of Cauvery water. However, it is disheartening to note that the KRS, responsible for safeguarding the dam, seems to be neglecting its duty. Have we truly comprehended the catastrophic consequences that could arise if the dam were to be damaged? The potential danger it poses to the entire state cannot be underestimated. Consequently, the bench has taken a decisive step by imposing a ban on mining activities near the KRS dam.
Let us delve into the details of the case at hand. The petitioner had submitted an application to the District Collector, seeking permission to conduct mining operations on his land. After careful examination, the District Collector granted permission, albeit with certain conditions.
Furthermore, it was mandated that the competent authority must adhere to any decisions made subsequent to the evaluation of the report submitted by the Cauvery Niravari Corporation, following the test blasting. Additionally, until the report is received, the converted land cannot be utilized for its intended purpose. Dissatisfied with this provision, the petitioner lodged an application with the High Court, demanding the repeal of this clause.
It is imperative to recognize the significance of preserving the integrity of the dam and the potential ramifications of any damage inflicted upon it. The ban on mining near the KRS dam serves as a crucial step towards safeguarding the state and its inhabitants from potential disasters.
